The laws related to the penalties for OUI with Marijuana in Massachusetts are the same as for an OUI involving alcohol.  The only real difference between an OUI with alcohol and an OUI with marijuana is that there is currently not a breath test to measure intoxication from marijuana.  Because there is no breath test, there is currently no “refusal” law as it pertains to marijuana OUI.

Civil and Criminal Penalties for OUI

Just as in the case of an OUI with alcohol, there are two individual sets of potential consequences a driver faces after being arrested for an OUI:

  • Penalties from the criminal charge of OUI
  • License restrictions from the Massachusetts RMV (Registrar of Motor Vehicles)
