Penalties for OUI in Massachusetts

Worcester DUI Penalties Attorney

Attorney in Worcester, Massachusetts: DUI Defense

Challenging the Serious Penalties of DUI

If you have been charged with drinking and driving in Massachusetts, you want an experienced lawyer to protect your interests. The penalties can be severe, including the loss of your driving privileges, increased automobile insurance premiums, substantial fines, even incarceration. You want an attorney with a comprehensive understanding of the law who has successfully helped other people that have been in your position.

At the Law Office of Richard A. Mulhearn, P.C., we defend people throughout the state of Massachusetts who have been charged with DUI, DWI, and OUI. In a country where the transportation system is built predominately around the automobile — and few options for public transportation exist — we strongly believe that the DUI penalties in Massachusetts are disproportionate to the offense. People are extraordinarily punished often for being in the wrong place at the wrong time. For a free initial consultation, contact us by e-mail or call 508-753-9999.

Representing Students throughout Massachusetts

If you are a student at one of the colleges or universities in Massachusetts, including WPI, Holy Cross, Worcester State or Clark University, we will defend you against charges of underage drinking and driving. A conviction could affect your ability to go to school and can result in severe penalties, including a 200 day license suspension on the first offense, even with an alternative disposition. See our page on Melanie’s Law to learn more about the potential consequences of underage drinking and driving.

Working to Make Certain that You Are Not Unfairly Punished

In Massachusetts, the DUI penalties can be substantial. For a first offense, you can face up to two and a half years in jail, a $5,000 fine, and the loss of your driving privileges for a year. For a repeat offense, a jail sentence is likely, you could face a 2 year driver’s license suspension, or you may be required to spend 14 days in a rehab center (sometimes called an alternative disposition). For a third offense, there is a mandatory 150 day jail sentence.

Massachusetts Driver’s License Suspension Lawyer

In spite of the fact that the odds seem stacked against you, we can help to minimize the consequences of a first offense through alternative or diversionary programs, including driver alcohol education programs. When these strategies are employed, we can often reduce the driver’s license suspension to 45-90 days. In limited circumstances, we can get you a hardship license during the period of suspension, giving you the opportunity to drive for limited purposes, such as school or work.

We also work closely with individuals facing increased DUI penalties under Melanie’s Law, which increases sanctions for the refusal to take a blood alcohol test.
